Welcome to Nexa, a service provided by Divinify (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our software, services, and website. By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services Provided

Divinify provides subscription-based software (Nexa), marketing services, consulting, and video production. Additional features and updates may be introduced at our discretion.

2. Eligibility

You must be at least 18 years old to use our services. By using Nexa, you represent and warrant that you meet this age requirement.

3. Account Registration

You may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Payment & Subscriptions

  • Payments are processed securely through Stripe.

  • Subscriptions automatically renew unless canceled with at least 30 days’ notice.

  • No refunds are issued once a payment is made.

  • You are responsible for ensuring your payment method remains current.

5. Communications Consent

By using Nexa, you consent to receive:

  • Service updates

  • Billing notifications

  • Marketing emails and promotional offers

  • SMS reminders, updates, and notifications

You may opt out of promotional communications at any time by following the unsubscribe instructions or replying “STOP” to SMS.

6. Acceptable Use

You agree not to:

  • Misuse the platform for unlawful purposes

  • Interfere with system operations or security

  • Upload harmful, misleading, or unauthorized content

7. Intellectual Property

All content, trademarks, and software features within Nexa are the property of Divinify. You may not copy, distribute, or reverse engineer without written consent.

8. Disclaimer of Warranties

Nexa and all related services are provided “as is” without warranties of any kind, express or implied.

9. Limitation of Liability

To the fullest extent permitted by law, Divinify shall not be liable for indirect, incidental, or consequential damages resulting from your use of Nexa.

10. Termination

We may suspend or terminate your access if you violate these Terms. You may terminate by canceling your subscription with proper notice.

11. Dispute Resolution

  • Mediation: Parties shall attempt to resolve disputes through good-faith mediation in the State of Georgia.

  • Arbitration: If mediation fails, disputes shall be resolved by binding arbitration in Georgia under the American Arbitration Association rules.

  • Exclusivity: Arbitration is final and binding, and judgment may be entered in any court of competent jurisdiction.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA.
